*General terms and conditions for using Freshcabs taxi services*

Definitions:
– Freshcabs: Refers to Freshcabsbeheer BV, the owner of the 013.taxi website and the operator of the taxi services.
– Customer: An individual or entity that uses Freshcabs taxi services.
– Driver: The driver of the vehicle used for Freshcabs taxi services.
– Vehicle: The vehicle used for the provision of taxi services by Freshcabs.
– Ride: A taxi ride carried out by Freshcabs at the customer's request.
– Online reservation system: The system available on the 013.taxi website that allows customers to reserve taxi rides and make advance payments.

1. Order:
1.1 Taxi rides can be ordered in various ways, including by telephone, by e-mail, via WhatsApp, and via the online reservation system where payment is required in advance.
1.2 Freshcabsbeheer BV, owner of the 013.taxi website, will at all times make every effort to ensure that journeys run on time and correctly.
1.3 In the event of unforeseen circumstances where something goes wrong, Freshcabs can only provide compensation for online reservations that have been paid in advance if there is a delay or a forgotten ride.
1.4 Compensation for consequential damage will only be awarded if:
– Upon arrival at the departure address, Freshcabs is 1 hour late and a flight is missed as a result.
– Upon arrival at the departure address, Freshcabs is half an hour late and a bus and train are missed as a result.
– The compensation is limited to EUR 500,00 and a full refund of the taxi ride.
1.5 Compensation will not be given for reservations made by telephone, WhatsApp or email. Refunds cannot be given on rides reserved through these channels.
1.6 For reservations made in advance that have also been paid, the customer will receive a 50% refund in the event of a half-hour delay. In case of a delay of one hour, the customer will receive a 100% refund. Exceptions to this are rides during festivals, New Year's Eve, Christmas, Friday and Saturday evenings and nights.

2. Cancellation policy:
2.1 In accordance with Article 6:230p paragraph 1 sub h of the Civil Code, the cancellation conditions for the Distance Selling Act do not apply to taxi rides, as taxi rides are considered travel services and do not fall under the Distance Selling Act.
2.2 Cancellation of a taxi ride must be done as soon as possible and can be done via the same channels through which the ride was ordered (by telephone, by e-mail, via WhatsApp, or via the online reservation system).
2.3 If you cancel a taxi ride, cancellation costs may be charged, depending on the time of cancellation and the circumstances of the ride. These charges may vary and will be communicated at the time of cancellation.
2.4 Freshcabs reserves the right to charge a cancellation fee for taxi rides canceled with insufficient notice or without valid reason, as determined by Freshcabs in its sole discretion
2.5 In the event of a no-show, where the customer does not appear at the agreed time and location without prior cancellation, no refund will be given.
2.5 If Freshcabs Beheer BV cancels the taxi for any reason, the customer will be fully refunded without any cancellation fees or penalties.
2.6 The booking of a taxi ride implies the acceptance of this cancellation policy by the customer.

3. Waiting time at the pick-up address:
3.1 If you wait longer than 2 minutes at the pick-up address, Freshcabs may charge an hourly rate of EUR 55,00.
3.2 These costs must be paid to the driver, unless otherwise arranged, and cannot be settled automatically via the app.
3.3 If the waiting time at the pick-up address is longer than 10 minutes, the driver reserves the right to cancel the ride.
3.4 The driver must be able to prove that he has been on location by means of photos of the location and screenshots from his or her phone.

4. Customer Behavior:
4.1 Customers must behave decently and respectfully at all times while using Freshcabs taxi services.
4.2 Inappropriate behavior, such as aggression, verbal abuse, discrimination, intimidation or other disruptive behavior towards the driver or other passengers will not be tolerated.
4.3 Customers must follow the driver's instructions and comply with applicable laws and regulations during the journey.
4.4 Freshcabs reserves the right to refuse or cancel the ride if a customer does not adhere to these rules of conduct, without refund of any costs paid.
4.5 Customers are responsible for any damage to the vehicle caused by their behavior during the journey and may be held liable for the costs of repair or cleaning.
4.6 Freshcabs will take appropriate action against customers who do not comply with these rules of conduct, including reporting the incident to the competent authorities if necessary.

5. Car tracking system and safety (continued):
5.1 Freshcabs reserves the right to use a car tracking system to ensure the location of the vehicles and the safety of both passengers and drivers.
5.2 This car tracking system can be used for purposes such as route tracking, speed monitoring, and providing emergency support.
5.3 If necessary, Freshcabs can also use camera systems in the vehicles to promote the safety of the drivers and to register incidents.
5.4 The use of camera systems will take place in accordance with applicable laws and regulations in the field of privacy and data protection.
5.5 Freshcabs will take the necessary measures to ensure the privacy of both passengers and drivers when using camera systems, and will only use these images for the purposes stated above.
5.6 Customers are informed about the use of camera systems in the vehicles and can object to their use if they wish.

6. Liability for damage to the vehicle:
6.1 Freshcabs is not liable for damage to the vehicle during the ride as a result of Freshcabs' own fault, the actions of someone else, or a technical defect.
6.2 Examples of circumstances for which Freshcabs is not liable for damage to the vehicle include, but are not limited to:
– Damage caused by an accident or collision for which Freshcabs is not at fault.
– Damage resulting from vandalism, theft or burglary of the vehicle during the journey.
– Damage caused by another road user, such as another vehicle, pedestrian or object, for which Freshcabs is not liable.
– Damage resulting from technical defects in the vehicle that are not due to the negligence or fault of Freshcabs.
6.3 If such a circumstance occurs, this does not release the customer from the obligation to pay for the ride up to the time of the damage.
6.4 If there is a fixed price for the journey, it will be calculated pro rata to the final address, regardless of the time at which the damage occurs.
6.5 Freshcabs advises customers to be vigilant during the journey and to keep their personal belongings safe. Customers are advised not to leave valuables unattended in the vehicle.
6.6 Freshcabs will take reasonable measures to ensure the safety of the vehicle and passengers, but cannot be held liable for damage to customers' personal property.
6.7 Customers are advised to report any damage to the vehicle immediately to the driver and to Freshcabs so that appropriate action can be taken.

7. Liability to the customer:
7.1 The customer is liable for damage caused to the Freshcabs vehicle as a result of negligence, intentional damage, misconduct or other acts during the ride, including, but not limited to:
– Damage caused by improper handling of the vehicle, such as causing scratches, dents, or other damage.
– Damage resulting from vomiting in the vehicle, resulting in cleaning and/or disinfection costs.
– Damage caused by smoking in the vehicle, including odor removal and cleaning costs.
– Damage resulting from the vehicle becoming so dirty that professional cleaning is required.
7.2 If there is any damage due to standstill, as defined in the insurers' business interruption agreement, the customer is obliged to compensate this damage in accordance with the conditions stated therein.
7.3 Freshcabs reserves the right to charge the customer for the costs of repair, cleaning or other recovery work as a result of the circumstances mentioned above.
7.4 The customer is deemed to be aware of his or her responsibilities regarding the correct use of the vehicle and agrees to reimburse any costs arising from his or her negligence or misconduct during the journey.
7.5 The customer is informed about the liability conditions in various ways, including, but not limited to:
– Posting the liability conditions on the Freshcabs website, booking platform or app, where customers can book their rides. Customers must accept these terms before confirming a ride.
– Sending a confirmation email to the customer after booking a ride, summarizing the main points of the liability conditions and a link to the full conditions.
– Installation of an information board in Freshcabs vehicles stating the liability conditions. This sign can be hung in the interior of the vehicle, visible to customers during their ride.
– Periodic automatic reminders via email or text message to customers, re-emphasizing the liability conditions and stating that they agreed to these conditions when booking their ride.

8. Prohibited Items:
8.1 The customer may not carry any prohibited items on the ride, including but not limited to narcotics, weapons, ammunition, large amounts of cash, flammable substances, explosives, toxic or hazardous chemicals, and large and bulky objects that could compromise the safety of the ride unless there is a government decision to this effect.
8.2 Even if there is a government order, the driver reserves the right to refuse the carriage of such items if he or she deems this necessary for the safety of himself, other passengers or the vehicle.
8.3 In the event of refusal by the driver to transport prohibited objects, the customer will not be entitled to a refund of any costs for the booked trip.

9. Payment in the taxi:
9.1 Payments in the taxi must be made correctly if payment is made in cash.
9.2 Payments by PIN are allowed and accepted.
9.3 If the customer chooses to pay by American Express or Diners Club credit card, Freshcabs reserves the right to charge a surcharge in accordance with Regulation (EU) 2015/751 of the European Parliament and of the Council of 29 April 2015 on fees for cross-border payments in the Union and amending Regulation (EU) No 260/2012 (OJ L 123, 19.5.2015, p. 1).
9.4 Any surcharges for the use of certain credit cards will be communicated to the customer prior to payment.

10. Conclusion of the agreement
10.1 An agreement for taxi services can be concluded when a customer places an order for a taxi ride via one of the available channels, including by telephone, by e-mail, via WhatsApp, or via the online reservation system on the 013.taxi website.

10.2 By placing an order, the customer agrees to the general terms and conditions of Freshcabs, as stated on the 013.taxi website and in other means of Freshcabs communication.

10.3 Freshcabs reserves the right to refuse or cancel orders for reasons such as driver unavailability, technical problems, or other operational barriers. In the event of cancellation, Freshcabs will make reasonable efforts to inform the customer and, where possible, offer alternative arrangements.

10.4 After the conclusion of the agreement, the customer will receive a confirmation message with the details of the booked trip, including the date, time, pick-up location, destination, and any special instructions or requirements.

10.5 The customer is responsible for checking the accuracy of the details in the confirmation message and reporting any errors or discrepancies to Freshcabs as soon as possible.

10.6 Freshcabs reserves the right to change or adapt the agreement in the event of unforeseen circumstances or changes in the availability of drivers or vehicles. In such cases, Freshcabs will make reasonable efforts to inform the customer and, if necessary, offer alternative arrangements.

11. Establishment in the taxi

11.1 If a customer boards a Freshcabs taxi and agrees to the legally determined meter rates, an agreement for taxi services can also be concluded at that time.

11.2 By boarding the Freshcabs taxi and agreeing to the meter rates, the customer agrees to the Freshcabs general terms and conditions.

11.3 Boarding the taxi and agreeing to the meter rates implies acceptance of the Freshcabs general terms and conditions by the customer.

11.4 Customers who use the services of Freshcabs by boarding a taxi and agreeing to the meter rates must at all times adhere to the payment terms set out in these general terms and conditions and any additional terms and conditions set by Freshcabs .

12. Trips on account

12.1 Freshcabs offers the option for customers to place taxi rides on account, subject to approval from Freshcabs.

12.2 To request rides on account, the customer must submit a request to Freshcabs, providing relevant information, such as company details, billing details and any other required information.

12.3 Placing an order for a ride on account implies acceptance of the general terms and conditions of Freshcabs by the customer.

12.4 Freshcabs reserves the right to refuse requests for rides on account without stating reasons.

12.5 For journeys on account, a payment term of a maximum of 31 days after the invoice date applies, unless otherwise agreed.

12.6 If the payment term is exceeded, any agreed discounts will lapse.

12.7 In the event of default, the customer owes statutory interest on the outstanding amount, as well as collection costs as legally established in the Decree on compensation for extrajudicial collection costs.

12.8 The costs of recovery from the debtor, including legal costs and collection costs, can be recovered from the debtor if these costs arise from the customer's failure to meet payment obligations.

12.9 Freshcabs reserves the right to impose additional conditions on placing rides on account, including but not limited to establishing a credit limit, requiring advance payments, and requiring guarantees or security.

12.10 Customers who use the option for rides on account must at all times adhere to the payment terms as set out in these general terms and conditions and any additional terms and conditions set by Freshcabs.

These are the general terms and conditions for using Freshcabs taxi services. Please note that these terms may change from time to time and it is the customer's responsibility to keep abreast of any updates.
